The onetime student, Christopher Moore, filed the suit against the other former student, Tim Delea, and also named as defendants the school board, the township and the student’s parents, Robert and Karen Delea. In the settlement he signed on June 15, Moore agreed to release all claims and liabilities against all the defendants, and they admitted no wrongdoing. The terms remained confidential, butthe settlement was obtained by open public records advocate John Paff and posted at his website, NJCivil Settlements. In the lawsuit, Moore claimed that he was near the high school, on a path owned by the school board and/or the town, when Delea assaulted him on Oct. 26, 2009. Prior to the assault, Moore said, Delea had “exhibited a series of behaviors” toward him that were “tantamount to harassment, intimidation and/or bullying,” as defined in New Jersey’s Anti-Bullying Act. The board of education and the township had both been informedbefore Oct. 26 that Delea was harassing and bullying Moore and other students, the lawsuit charges. However, the township and school board had both failed “to take reasonable action” against Delea, even though they were responsible for supervising him, Moore and the other students, the lawsuit says. As a result of the continuing harassment, bullying and the assault, the lawsuit says, Moore has suffered “severe, painful and permanent bodily and emotional injuries which have caused and will in the future cause him to incur various and diverse expenditures for medical treatment and care.” Those injuries, the lawsuit says, will “continue to incapacitate (Moore) and render him incapable of pursuing his regular and ordinary occupational activities” and “may result in significant lost wages as a result of the negligence of defendants.” The lawsuit did not describe the exact nature of Moore’s injuries, but said they were also due to the “dangerous and hazardous conditions” of the path to Station Park, where the alleged incident occurred in 2009. Moore, who was a minor in 2009, signed the settlement agreement in Broward County, Florida on June 15.
